In Texas, you are considered publically intoxicated if you have lost the normal use of your mental or physical facilities to the point you are a danger to yourself or others. However practically speaking, police often use this charge as a crowd control measure.
How Do You Handle Public Intoxication Charges?
Often times people are brought in on this charge with virtually no evidence. It is a shame because even the name, public intoxication, has a negative connotation that can affect employment, not to mention your criminal record.
